Orders:
Work will only commence on Come On In - 3D Virtual Tours acceptance of full project design specifications detailing all goods and services required including the location where services are to be rendered. Come On In - 3D Virtual Tours reserves the right not to accept an order at its discretion. Changes and additions to project specifications may be made prior to Customer acceptance of the goods and services ordered, but Come On In - 3D Virtual Tours reserves the right to charge the Customer for any work undertaken until the time at which changed and/or new project specifications are provided to it Come On In - 3D Virtual Tours also reserves the right to charge for additional work ordered due to new project specifications provided to it.
Should the Customer cancel an order after order confirmation by Come On In - 3D Virtual Tours, the Customer will be charged for all work undertaken up until the time notice of cancellation is received by VR Tours, including any travel costs already booked and paid for by Come On In - 3D Virtual Tours if services are to be rendered outside the Gold Coast Metropolitan Area.
Delivery:
Come On In - 3D Virtual Tours will make every effort to deliver goods and services ordered within the time frames specified to the Customer upon order confirmation. Come On In - 3D Virtual Tours commits to keeping it’s Customers informed of any delivery delays arising from circumstances beyond it's control. In no event will Come On In - 3D Virtual Tours be held responsible for losses incurred to the Customer for delivery delays caused by circumstances outside it's control. Unless otherwise agreed, the Customer is responsible for arranging access to the location at which the services are to be rendered.
A photographic virtual tour or 3D virtual tour is deemed delivered by Come On In - 3D Virtual Tours when all files which constitute a virtual tour have been either electronically received by the Customer or any Third Party nominated to receive the files, or when the files have been uploaded to the Customer’s designated web server, or if Come On In - 3D Virtual Tours is hosting the Customer’s virtual tour when the files have been uploaded to Come On In - 3D Virtual Tours web server and a URL link has been provided to the Customer.
Still photographs are deemed delivered when all digital images have been delivered electronically, on CD-Rom, or uploaded to Come On In - 3D Virtual Tours web server for Customer download, have been physically received by the Customer or any Third Party nominated to receive the files. If any deliverables are required to be couriered to the Customer, Come On In - 3D Virtual Tours will charge the customer for all postage and handling fees incurred by it.
A video tour is deemed to be delivered by Come On In - 3D Virtual Tours when all video files have been delivered electronically, or a DVD disc has been physically received by the Customer or any Third Party nominated to receive the disc. If any deliverables are required to be couriered to the Customer, Come On In - 3D Virtual Tours will charge the customer for all postage and handling fees incurred by it. A video tour is also deemed to be delivered by Come On In - 3D Virtual Tours when a copy of the video tour has been uploaded to YouTube and a URL link to the video supplied to the Customer.
A 2D or 3D floor plan is deemed delivered by Come On In - 3D Virtual Tours when all graphical floor plan files have been either electronically received by the Customer or any Third Party nominated to receive the files.
A web site is deemed delivered by Come On In - 3D Virtual Tours when all files which constitute a finished web site have been either electronically received by the Customer or any Third Party nominated to receive the files, or when the files have been uploaded to the Customer’s designated web server, or if Come On In - 3D Virtual Tours is hosting the Customer’s web site files then when all files have been uploaded to Come On In - 3D Virtual Tours web server.
Come On In - 3D Virtual Tours takes no responsibility for the goods and services rendered once they have been delivered and accepted by the Customer.
Acceptance:
The Customer is deemed to have accepted the goods and services delivered when all delivery criteria has been completed in accordance with the delivery definitions in the section headed 'Delivery' above.
Prices:
Prices quoted by Come On In - 3D Virtual Tours are subject to change at any time. Come On In - 3D Virtual Tours will endeavour to inform the Customer of changes to prices initially quoted for a project and of any chargeable costs for work undertaken additional to those agreed to at the time of order confirmation.
GST:
All prices quoted by Come On In - 3D Virtual Tours are in Australian dollars and are exclusive of GST (Goods and Services Tax) unless otherwise stated.
Travel Costs:
If goods and services are required to be rendered outside the Gold Coast Metropolitan Area the Customer will be charged for all travel and accommodation expenses incurred by Come On In - 3D Virtual Tours, at the cheapest available rates at the time of booking. Travel costs may include airfares, hotel accommodation, car hire, petrol for hire car, taxis to airports or shoot locations if required. If the photographer is driving to a shoot location and is required to travel further than 1 hour, then an hourly travel rate will be charged at $40 per hour traveled.
Invoicing:
An invoice will be issued via email on customer acceptance of the goods and services rendered or as specified in any non standard payment terms agreed to.
Payment Terms:
Full payment is due prior to booking date or no later than 14 days after invoice date unless otherwise agreed which ever comes first. Come On In - 3D Virtual Tours reserves the right should it choose to, to charge daily interest on any amount outstanding or overdue after it’s standard payment terms. Late payment and overdue invoice reminders will be sent to the Customer if payment has not been received within 14 days.
Payment Method:
Payments may be made via Electronic Funds Transfer (EFT), Stripe and Credit Card.
Refund Policy:
Come On In - 3D Virtual Tours does not provide any refund on the services it produces or refunds for change of mind by the Customer. A refund will also not be issued to the Customer if an order is cancelled before completion of the job. If any product or service produced by Come On In - 3D Virtual Tours is deemed faulty or not in full working order upon delivery, then Come On In - 3D Virtual Tours will remedy the defect in the product or service.
Copyright:
All copyright and ownership of panoramic and associated imagery originally captured by Come On In - 3D Virtual Tours or produced by it which constitute a photographic virtual tour or a 3D virtual tour, will reside with Come On In - 3D Virtual Tours at all times. Come On In - 3D Virtual Tours holds all rights to the idea, to the intellectual property, to the techniques employed to produce the virtual tour, and to any other technical information. Come On In - 3D Virtual Tours reserves the right to seek compensation for any financial losses incurred due to any breach by the Customer of the above stated rights. Unauthorised use or copying of Come On In - 3D Virtual Tours virtual reality tour technology and processes is not allowed under any circumstances. Come On In - 3D Virtual Tours reserves the right to use any panoramic images produced by it for promotional reasons in the media, in printed publications, on the world wide web, or as links on its own web sites, without prior permission from the Customer.
On Customer acceptance of a virtual tour rendered by Come On In - 3D Virtual Tours, the Customer is granted a single use licence with the following terms:
The Customer is licensed to use the virtual tour on, and only on, it’s own designated web site(s). The Customer has no copyright, authorship, or ownership rights to the panoramic virtual tour imagery or any other virtual tour files unless otherwise agreed to by Come On In - 3D Virtual Tours.
Additional copies or usage of a virtual tour beyond those specified in either of the two above licences may be permitted subject to terms agreed to by both Come On In - 3D Virtual Tours and the Customer, plus payment of additional agreed license fees to Come On In - 3D Virtual Tours.
Due to the technique employed to produce virtual tours, a small section of the panoramic image (the ‘cap’) on the base of the panorama, is without photographic content. Come On In - 3D Virtual Tours reserves the right to fill the cap area with its logo for promotional reasons. Subject to payment of an additional fee per panoramic image, other customer specified logos or images can be incorporated in the cap.
All copyright and ownership for still photos originally captured by Come On In - 3D Virtual Tours or produced by it will reside with Come On In - 3D Virtual Tours at all times. The Customer may use the finished images in any manner providing the intended use is not inappropriate, offensive or insulting to Come On In - 3D Virtual Tours or any other persons. Come On In - 3D Virtual Tours reserves the right to use any still images produced by it for promotional reasons in the media, in printed publications, on the world wide web, or on its own web sites, without prior permission from the Customer.
All copyright and ownership of images, text and animations which constitute a finished web site will reside with the Customer upon receipt of full payment. Come On In - 3D Virtual Tours reserves the right to reference and link to the finished web site for any promotional reasons. On all web sites that Come On In - 3D Virtual Tours designs and builds Come On In - 3D Virtual Tours reserves the right, should it choose to, to place a text link on the bottom of each page of the web site stating ‘Site designed by Come On In - 3D Virtual Tours’ which links to Come On In - 3D Virtual Tours own web site.
All copyright and ownership for a floor plan or area map produced by Come On In - 3D Virtual Tours will reside with the Customer upon receipt of full payment. Come On In - 3D Virtual Tours reserves the right to use any finished floor plan or area map produced by it for promotional reasons in the media, in printed publications, on the world wide web, or on its own web sites, without prior permission from the Customer.
All copyright and ownership for a video tour including raw video footage, animated 2D or 3D graphics, voice overs, or any other video component produced by Come On In - 3D Virtual Tours will reside with the Customer upon receipt of full payment. Come On In - 3D Virtual Tours reserves the right to use any finished video files produced by it for promotional reasons in the media, in printed publications, on the world wide web, or on its own web sites, without prior permission from the Customer.
All copyright and ownership for a finished video tour, including the raw video footage originally captured by it, will reside with Come On In - 3D Virtual Tours at all times. The Customer must deliver a hi-res version of their logo to be used in the video tour and copyright of the Customer’s logo will reside with the Customer at all times. Come On In - 3D Virtual Tours reserves the right to display the Customer’s video tour on it’s own web site for promotional purposes should it choose to, without prior permission from the Customer. Come On In - 3D Virtual Tours reserves the right should it choose to, to place it’s own logo at the end of the video for marketing and promotional reasons.
